General Terms of Use / Procreche Privacy Policy

Article 1. PREAMBLE: CREATIVE APP has developed and markets an exchange platform called PROCRECHE. This software allows the posting of comments and multimedia content regarding the reception conditions and activities of children. These general terms define the conditions of subscription and use. Anyone using the services is presumed to have read and accepted these general terms.

Article 2. DEFINITIONS: Definitions of all terms used in these GTU (including GDPR, PII, USER, CCS, etc.).

Article 3. PURPOSE: These terms define the rights of access and use of the SOLUTION's features for all persons accessing it.

Article 4. DESCRIPTION OF THE SOLUTION: PROCRECHE allows the exchange of content between USERS and SUPERVISORY STAFF. CREATIVE APP ensures the hosting, maintenance, and security of the SOLUTION.

Article 5. NETWORK AND ACCESS TO THE SOLUTION: Access to the SOLUTION requires an Internet connection. CREATIVE APP is not responsible for the proper functioning of this network.

Article 6. SECURING ACCESS: Access is secured by a password that the USER agrees to keep secret.

Article 7. PROTECTION OF EQUIPMENT: The USER assumes responsibility for the protection of their own equipment.

Article 8. QUALITY OF SERVICES: The USER acknowledges that the Internet network may suffer interruptions.

Article 9. SUSPENSION OF SERVICES: Access may be occasionally suspended for maintenance.

Article 10. USER LICENSE: The license is governed by the general terms of sale signed by the HOST STRUCTURE.

Article 11. PROCESSING OF PERSONAL DATA: The HOST STRUCTURE is and remains the sole and unique Data Controller for personal data. CREATIVE APP provides the tools to allow the HOST STRUCTURE to comply with the GDPR. Servers are hosted on AWS – AMAZON.

Article 12. DATA SECURITY: CREATIVE APP implements technical and organizational measures to prevent fraudulent access, loss, or alteration of data.

Article 13. AUTHORIZATION FOR DISSEMINATION & RIGHT TO IMAGE: The HOST STRUCTURE agrees to seek authorization from the holder of parental authority before disseminating multimedia content where a minor might appear.

Article 14. PUBLISHED CONTENT: Staff agree not to produce content contrary to the interest of the person being cared for.

Article 15. PROHIBITION OF EXTERNAL DISSEMINATION: Unless expressly agreed, no one may disseminate the content of the SOLUTION outside the family or authorized framework.

Article 17. RIGHTS OF INDIVIDUALS: In accordance with the law and the GDPR, the USER has the rights of access, rectification, opposition, deletion, and portability of data, exercisable by email at info@procreche.ma

Article 18. APPLICABLE LAW & JURISDICTION: Disputes subject to an attempt at amicable settlement then to the jurisdictions of Casablanca.
